1. Introduction and acceptance
These Terms and Conditions of Use ("Terms") govern your access to and use of www.the-knowledge-architect.com and any content, materials, resources, or members area made available on it (together, the "website").
The website is operated by The Knowledge Architect (Pty) Ltd (registration number 2026/118422/07), a company incorporated in South Africa ("The Knowledge Architect", "we", "us", "our").
By accessing or using the website, you agree to be bound by these Terms. If you do not agree, please do not use the website.
2. Scope of these Terms
These Terms apply to your use of the website only. They do not constitute, and do not form part of, the terms of any consulting, advisory, or other service engagement with us. Any such engagement is governed by a separate written agreement, which prevails over these Terms in respect of that engagement.
3. Definitions
In these Terms:
"Content" means all material on the website, including text, articles, the white paper and any other publications, frameworks, models, methodologies, diagrams, images, graphics, design, layout, and the selection and arrangement of that material.
"Members area" means any part of the website that requires you to register for, and log in to, an account.
"Intellectual Property Rights" means copyright, trade marks, design rights, database rights, know-how, and all other intellectual property rights, whether registered or unregistered.
4. Use of the website
We grant you a limited, non-exclusive, non-transferable, revocable right to access and use the website for your own lawful, personal, or internal business reference, subject to these Terms.

5. Members area and accounts
Parts of the website, including access to certain resources, are made available through a members area that requires you to register for an account.

Your account is personal to you. The access we grant is a limited, non-exclusive, non-transferable, revocable licence for your own use. You may not share, sell, or transfer your account or login, or use your account to make our resources available to others.
We may suspend or terminate your account at any time, without notice, if you breach these Terms (including the intellectual property restrictions below), if we suspect unauthorised or improper use, or for operational, legal, or security reasons.
Resources you access or download through the members area remain subject to the intellectual property restrictions in sections 6 and 7. Accessing content through an account does not grant you any additional rights to reproduce, share, or redistribute it.
6. Intellectual property
All Content on the website, and all Intellectual Property Rights in it, are owned by or licensed to The Knowledge Architect. This includes our published thinking — most notably the white paper and any articles — together with our frameworks, models, methodology, terminology, and the design and arrangement of the website.
The name "The Knowledge Architect", our logo, and any associated marks are registered trade marks of The Knowledge Architect (Pty) Ltd. You may not use them without our prior written consent.
Nothing on the website transfers any Intellectual Property Rights to you, or grants you any licence beyond the limited rights of use described in these Terms. All rights not expressly granted are reserved.
7. Permitted and prohibited use of Content
You may, for your own personal or internal business reference and provided you do not remove or alter any copyright, trade mark, or other proprietary notice:
- view and read Content on the website;
- print or download a single copy of a resource we have made available to you, for your own internal, non-commercial reference;
- share a link to a page on the website.
You may not, without our prior written consent:
- reproduce, republish, distribute, sell, licence, rent, broadcast, or otherwise make available any Content, in whole or in part, to any third party or for any commercial purpose;
- modify, adapt, translate, or create derivative works from any Content;
- remove, obscure, or alter any copyright, trade mark, attribution, or other proprietary notice;
- present any Content as your own, or in a way that misrepresents its source;
- use any Content to develop, market, or operate a competing service, methodology, or offering;

7.1 Automated access, scraping, and AI training
You may not use any automated system — including robots, spiders, scrapers, crawlers, or similar data-gathering or extraction tools — to access, copy, monitor, or extract any Content from the website.
You may not use any Content, in whole or in part, to develop, train, fine-tune, evaluate, or improve any machine-learning model, large language model, artificial-intelligence system, dataset, or similar technology, whether for commercial purposes or otherwise, without our prior written consent. The limited rights granted in these Terms expressly exclude any text-and-data-mining or AI-training use.
8. Downloadable materials and gated content
Where we make a resource available for download — including through the members area — we grant you a limited, personal, non-commercial, non-transferable licence to access and read it for your own internal reference only. You may not share the resource, or your means of accessing it, with any third party. All other rights are reserved, and the restrictions in sections 6 and 7 apply in full. 9. No professional advice
The Content on the website, including the white paper and any articles, frameworks, models, or other materials, is provided for general information purposes only. It reflects our views, experience, and approach, and is not a substitute for professional advice tailored to your organisation's specific circumstances.
Nothing on the website constitutes consulting, legal, financial, regulatory, or other professional advice, and no advisory, consulting, or client relationship is created by your accessing the website, registering an account, downloading any resource, or relying on any Content.
